Overview: Landlord & Tenant Lawyers
A notice about arrears lands, or the heating has failed and the messages are going unanswered. Landlord and tenant lawyers deal with the tenancy while it runs and with the fights that end it. Deposits and the limits on them, repairs and maintenance, arrears, the notices that must come first, applications to the tenancy board, unlawful entry, and claims for damage after a move out.
Residential tenancies are provincial, and the differences are real. Most provinces route disputes through a tenancy tribunal rather than a court, with its own forms and its own hearing style. Ask whether the firm appears there often. Ask which side it usually acts for, and whether the work is quoted per application or by the hour. Licensed paralegals can appear at the board in some provinces.
Bring the lease, the rent ledger, every notice sent or received, dated photographs, and the written exchanges. Requests made in writing count for more than a conversation nobody wrote down.
Each listing shows what a firm publishes about residential and commercial tenancy work. The province and city lists lead to firms near the rental, and each city page shows which of them are in the city itself.
Cost of landlord and tenant legal help in Canada
You can hire help for one task or for the whole dispute. Compare the same level of help: advice, application preparation and hearing representation are different services.
Residential tenancy guidance
These amounts concern residential disputes. Commercial leases and disputes outside the residential-tenancy system need a separate quote.

Ask before you hire
Will you prepare the paperwork, file and serve it, and speak at the hearing, or am I responsible for some of those steps?
Ways to control the cost
Ask a local legal clinic about tenant assistance and eligibility. Limited-scope legal work may let you pay only for the step you need.

Frequently asked questions
What does a landlord and tenant lawyer handle?
The life of a tenancy and the arguments inside it. Deposit or last month's rent questions, maintenance complaints, arrears, notices to end a tenancy, board applications and hearings, unlawful entry, and claims for damage after a move out. Some firms draft leases for owners and advise on rent increases. Commercial tenancies are handled by a partly different group of lawyers.
How does an eviction usually proceed step by step?
A notice in the prescribed provincial form comes first, with the reason and the end date on it. If nothing changes, the landlord applies to the tenancy board and both sides receive a hearing date. An adjudicator decides. Enforcement is carried out by a sheriff or bailiff, never by the landlord. The forms and the route depend on the province.
How are fees set in a tenancy dispute?
Commonly a flat fee per board application or per hearing, with hourly rates for anything that runs long or moves to a court review. Licensed paralegals can appear at the tenancy board in some provinces and usually charge less than a lawyer. Ask what the quote includes, whether filing costs are extra, and who will actually stand up at the hearing.
Can a landlord keep the security deposit?
Several provinces do not permit a damage deposit at all, and others cap it or allow only last month's rent held in advance. Where a deposit is allowed, deductions have to be justified and often need board approval rather than a landlord's own decision. Check the provincial rule first. A signed condition report at move in and move out protects both sides.
What can a tenant do when repairs are ignored?
Ask in writing and keep the record. If the landlord does not act, most provinces allow a tenant application to the board for repairs, a rent abatement, or an order that the work be done. Municipal property standards officers can also inspect. Stopping rent is risky and rarely the route an adjudicator wants to see, so raise it with a lawyer before you try it.
Who handles the sale of a rented property?
A real estate lawyer closes the sale and registers the transfer. Tenancy lawyers deal with the people living in the building: whether the tenancy continues, what notice a purchaser who intends to move in has to give, and how the deposit or last month's rent is passed across. Selling a building with tenants in it commonly needs both kinds of advice.
